1. Acceptance of Terms

By accessing or using Bunku+ ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

2. Eligibility

You must be at least 13 years old to use the Platform. If you are under 18, you must have parental or guardian consent. By using the Platform, you represent that you meet these requirements.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You may not transfer your account or share login credentials
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. User Content

4.1 Your Content

You retain ownership of content you create and upload to the Platform. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content on the Platform.

4.2 Content Standards

You agree not to post content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Infringes on intellectual property rights of others
  • Contains sexually explicit material involving minors
  • Promotes violence, discrimination, or hatred
  • Contains malware, spam, or deceptive content
  • Violates any applicable laws or regulations

4.3 Content Moderation

We reserve the right to remove any content that violates these Terms or our Community Guidelines. We may also suspend or terminate accounts that repeatedly violate our policies.

5. Creator Terms

If you use the Platform as a creator:

  • You must comply with all applicable laws regarding content creation and monetization
  • You are responsible for any taxes on income earned through the Platform
  • You must have the necessary rights to all content you upload
  • Payouts are subject to minimum thresholds and processing times
  • We may withhold payouts pending investigation of potential violations

6. Purchases and Payments

  • All purchases are processed securely through Stripe
  • Prices are displayed in USD unless otherwise specified
  • Digital content purchases are generally non-refundable
  • Subscription cancellations take effect at the end of the billing period
  • We reserve the right to change pricing with reasonable notice

7. Intellectual Property

The Platform and its original content, features, and functionality are owned by Bunku+ and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without permission.

8. Prohibited Activities

You agree not to:

  • Use the Platform for any illegal purpose
  • Attempt to gain unauthorized access to the Platform or other accounts
  • Interfere with or disrupt the Platform's operation
  • Use automated systems to access the Platform without permission
  • Circumvent any access restrictions or security measures
  • Impersonate others or misrepresent your affiliation
  • Engage in any form of harassment or abuse

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR USER-GENERATED CONTENT OR THIRD-PARTY SERVICES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUNKU+ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

11. Indemnification

You agree to indemnify and hold harmless Bunku+ and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your content, or your violation of these Terms.

12. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of [Arbitration Association]. You waive any right to participate in class action lawsuits.

13. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions that should survive termination will remain in effect.
